1. What Nailed is
Nailed (“we”, “us”) provides software that helps small general contractors prepare quotes, collect electronic signatures, send payment reminders and track job costs, mainly through a Telegram assistant and a web dashboard. By using Nailed you agree to these terms.
2. Not legal, tax or accounting advice
Nailed is a tool. It does not provide legal, tax or accounting advice. Quote templates, policy text and e-signature flows are starting points. You are responsible for your contracts, licenses, notices and for complying with the laws that apply to your work and your state.
3. The AI can make mistakes
Nailed uses AI to read voice notes, photos and messages. The AI can misunderstand. Totals are calculated by software, and anything that changes money asks you to confirm first. You must check every quote, amount and message before it goes to a client.
4. Your account
You must be authorized to bind the business you sign up for. Keep your Telegram and login credentials secure. You are responsible for activity under your account and for the people you add to it.
5. Plans, trial and billing
- Free trial: 14 days. Automatic texting is not included in the trial.
- Paid plans are billed monthly in advance through our payment processor. Prices are shown on our pricing page. Founding member pricing is locked for as long as the account stays active and in good standing.
- You can cancel at any time. Access continues to the end of the paid period. Except where the law requires otherwise, fees already paid are not refunded.
6. Texting your clients
When you use automatic texting, you confirm that you have your clients' consent to receive the messages you send through Nailed. See the SMS Terms. You must not use Nailed to send spam, marketing without consent, or unlawful content.
7. Your content and data
You own your content: quotes, client details, receipts and documents. You give us a license to host and process it to provide the service. How we handle personal data is described in the Privacy Policy.
8. Acceptable use
Do not misuse the service, attempt to access other accounts, reverse engineer it, or use it for anything illegal.
9. Availability and changes
We work to keep Nailed available but do not promise uninterrupted service. We may change features and will give reasonable notice of material changes.
10. Disclaimers and limits of liability
Nailed is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential damages, lost profits, or disputes between you and your clients, and our total liability is limited to the fees you paid in the 12 months before the claim. [Lawyer to confirm.]
11. Termination
You may stop using Nailed at any time. We may suspend accounts that break these terms. On request we will provide an export of your documents.
